De redactie van Philosophia Reformata heeft een belangrijk project opgezet. Aan de schrijvers van het boek van de Open Universiteit waaraan vertegenwoordigers van verschillende levensbeschouwelijke richtingen hebben meegewerkt, is de mogelijkheid geboden met elkaar in dialoog te treden. De bijdrage van Kees Klop biedt daarvoor om verschillende redenen een uitstekende basis. Ik heb het getroffen met een commentator die de lijn van mijn verhaal voortreffelijk heeft samengevat. We behoeven dus geen tijd te verdoen met het rechtzetten van misverstanden, iets dat (...) doorgaans een belangrijk onderdeel vormt van reacties. Ik vlei mij een beetje met de gedachte dat Klops sympathieke weergave van de essentie van mijn betoog ook wellicht daarom zo goed geslaagd is, omdat wij putten uit ten dele verwant gedachtengoed. Ik ben namelijk, net als Klop, onder de indruk van het werk van Dooyeweerd. Dat gaat terug op de tijd dat ik als student-assistent verbonden was aan de afdeling Encyclopedie van de rechtswetenschap van de VU bij Prof. H.J. van Eikema Hommes. Laatstgenoemde was, zoals de lezers van Philosophia Reformata bekend is, een leerling van Dooyeweerd. (shrink)

The accession and implementation of new generation free trade agreements bring numerous opportunities as well as challenges to Viet Nam, regarding trade, labor and investment. The increasing number of workers abroad puts a pressure on Vietnamese government to support them in new working cultures and environments. The application of chatbot, which has been known to help certain vulnerable groups such as patients, women and migrants could be one of the tools to support Vietnamese migrant workers by providing immediate information, network (...) connection and consultation. Analyzing the results of the qualitative interviews with 11 migrant workers and the group discussion with two sections from three public social media groups and three active informants, the article argues that migrant workers as a vulnerable group who are supposed to be promising users of chatbot due to their great demand and needs, may have a complicated form of trust and expectation in chatbot. This paper argues that the principles of spiritual traditions provide normative ‘standards of goodness’ within which practitioners evaluate meaningful work. Our comparative study of practitioners in the Buddhist and Quaker traditions provide a fine-grained analysis to illuminate, that meaningfulness is deeply connected to particular tradition-specific philosophical and theological ideas. In the Buddhist tradition, meaningfulness is temporal and rooted in Buddhist principles of non-attachment, impermanence and depending-arising, whereas in the Quaker tradition, the Quaker testimonies and theological ideas frame meaningfulness as eternal. Surprisingly, we find that when faced with unethical choices and clashes between organizational normativity and spiritual normativity, Buddhist practitioners acknowledge the temporal character of meaningfulness and compromise their moral values, whereas in contrast, Quaker practitioners morally disengage from meaningless work. Our study highlights how normative commitments in different spiritual traditions can influence different levels of adaptability in finding work meaningful and stresses the central importance of normative commitments in meaningful work. Our study concludes with practical implications and future pathways for inter-disciplinary research. (shrink)

As a transitional economy, Vietnam has undergone tremendous changes over recent decades within a ‘fusion’ context that blends both traditional and modern values from its complex history. However, few studies have explored how contemporary issues in the context of Vietnam have brought both obstacles and skillful initiatives to managerial approaches to doing business. We draw on the concepts of social trust and institutional theory to explore how informal institutions such as religious forces can contribute to the development of individual trust (...) and whether individuals are willing to extend trust beyond familial networks. We contribute to the notion of a moral conception of trust by exploring how Buddhism in particular has initiated distinctive managerial approaches in the context of Vietnam, in response to dilemmas of social trust. Our findings highlight that as an informal institution, engaged Buddhism yields significant impact on the formation of social trust. We carried out in-depth interviews in Vietnam with 33 organizational leaders who were Buddhist practitioners, using thematic analysis to elucidate our findings and arguments. The study reveals how the incorporation of Buddhist principles has fostered context-sensitive, non-extreme, and reflexive managerial approaches to enhance morality as a response to social trust issues. We present our method for tackling a legal case retrieval task by introducing our method of encoding documents by summarizing them into continuous vector space via our phrase scoring framework utilizing deep neural networks. On the other hand, we explore the benefits from combining lexical features and latent features generated with neural networks. Our experiments show that lexical features and latent features generated with neural networks complement each other to improve the retrieval system performance. Furthermore, our experimental results suggest the (...) importance of case summarization in different aspects: using provided summaries and performing encoded summarization. Our approach achieved F1 of 65.6% and 57.6% on the experimental datasets of legal case retrieval tasks. (shrink)

This study explores the role of an informal institution—engaged Buddhism—in leadership responses to issues of bribery at the firm level in the context of Vietnam. In-depth interviews were carried out in Vietnam with 26 organizational leaders who were Buddhist practitioners. The leaders expressed a Buddhist-enacted utilitarian approach based on three context-associated mechanisms: karmic consequences, community and social well-being, and total detachment. These mechanisms manifest in leadership approaches based on the Middle Way, Skillful Means, and Emptiness. They are involved in forming (...) leaders’ perceptions about bribery issues and their enacting of contextual approaches to balance organizational means and ends in tackling ethical issues associated with bribery. The study also sheds light on moral struggles involved in the process of shaping and enacting a Buddhist-enacted utilitarian approach. (shrink)

Using a nationwide survey of provincial institutional quality and a sample of private manufacturing small and medium scale enterprises, this paper contributes to the literature by considering for the first time the effects of corruption on the financial performance of Vietnamese private SMEs. Interestingly, contrary to previous findings, we find that corruption when measured by a dummy variable, does not affect firms’ financial performance after controlling for heterogeneity, simultaneity and dynamic endogeneity. However, the intensity of bribery and the majority of (...) the forms of corruption were found to have negative impacts on firms’ financial performance. Hence, a typical approach using only a dummy variable for bribery might not adequately evaluate the impact of bribe intensity or even ignores the negative impacts of some types of bribes on firms’ financial performance. The findings suggest that anti-corruption measures are vital for the development of the Vietnamese private SMEs. (shrink)

This paper draws on an institutional logics perspective to illuminate a hitherto underexplored context for CSR professional identity construction. It draws on an empirical study of 65 CSR professionals in South Korea and aims to deepen our understanding of CSR professional identity construction by investigating the contested nature of the CSR professional field between, on the one hand, societal-normative expectations of the profession, and, in the absence of stable professional logics, CSR professionals’ desired professional identity, on the other. Our study (...) reveals how CSR professionals engage with, and respond to, this complexity through constructing one of three distinctive professional identities based on different logic constellations. With a focus on the Common Law jurisdiction of England and Wales and the Civil Law jurisdiction of Vietnam, this article provides an analytical framework to address the uncertain jurisprudence of minor offence processes. The article’s approach is to seek an account of crime and criminal process that is most suitable for practice and most compatible with the broad notion of ‘criminal charge’ under international human rights instruments. It is argued that minor offences should be considered forms of less serious (...) crimes that are subject to short periods of imprisonment or non-custodial punishments and dealt with by summary procedures. The fragmentation of minor offences demands an approach to procedural pragmatism and procedural proportionality; that is, the procedure for each type of offence should be proportionate to the severity of punishment and fair as a whole. The literature on meaningful work often highlights the role of leaders in creating a sense of meaning in the work or tasks that their staff or followers carry out. However, a fundamental question arises about whether or not leaders are morally responsible for providing meaningful work when perceptions of what is meaningful may differ between leaders and followers. Drawing on Buddhist ethics and interviews with thirty-eight leaders in Vietnam who practise ‘engaged Buddhism’ in their leadership, we explore how leaders understand (...) their roles in creating meaningfulness at work and their perceptions of how employees experience their leadership approach in this respect. On the basis of Buddhist ontology on the sense of meaningfulness, we introduce a number of leadership approaches in cultivating meaning at work that question the argument that leaders are primarily responsible for enabling or satisfying employees’ search for meaning. The study provides an alternative lens through which to examine the role of leadership from a Buddhist ethics perspective and shows how an insight from this particular tradition can enrich secular interpretations of meaningful work and leadership. This study examines non-Western perceptions of inclusion and exclusion through an examination of right mindfulness practitioners in Vietnam. It contributes to the critical inclusion literature that problematizes inclusion by showing how right mindfulness practitioners rejected the concepts of inclusion and exclusion, and moreover, resisted attachments to feelings of inclusion or exclusion, treating both states as empty and non-enduring. Surprisingly, our study shows how inclusion can generate fear at fulfilling others’ collective expectations, whereas exclusion generated a sense of freedom arising from (...) a release from those expectations. Further, our study traces these counter-intuitive findings to right mindfulness practitioners’ moral reasoning based upon Buddhism’s canonical philosophical ideas. We conclude by highlighting the pressing need for critical perspectives and for further non-Western perspectives to inclusion that contribute to a body of cross-cultural work. (shrink)

Natural language processing techniques contribute more and more in analyzing legal documents recently, which supports the implementation of laws and rules using computers. Previous approaches in representing a legal sentence often based on logical patterns that illustrate the relations between concepts in the sentence, often consist of multiple words. Those representations cause the lack of semantic information at the word level. In our work, we aim to tackle such shortcomings by representing legal texts in the form of abstract meaning representation, (...) a graph-based semantic representation that gains lots of polarity in NLP community recently. We present our study in AMR Parsing and AMR-to-text Generation specifically for legal domain. We also introduce JCivilCode, a human-annotated legal AMR dataset which was created and verified by a group of linguistic and legal experts. We conduct an empirical evaluation of various approaches in parsing and generating AMR on our own dataset and show the current challenges. Based on our observation, we propose our domain adaptation method applying in the training phase and decoding phase of a neural AMR-to-text generation model. In this chapter, we aimed at further characterizing the functional neuroanatomy of the human rapid eye movement (REM) sleep at the population level. We carried out a meta-analysis of a large dataset of positron emission tomography (PET) scans acquired during wakefulness, slow wave sleep and REM sleep, and focused especially on the brain areas in which the activity diminishes during REM sleep. Results show that quiescent regions are confined to the inferior and middle frontal cortex and to the inferior parietal (...) lobule. Providing a plausible explanation for some of the features of dream reports, these findings may help in refining the concepts, which try to account for human cognition during REM sleep. In particular, we discuss the significance of these results to explain the alteration in executive processes, episodic memory retrieval and self representation during REM sleep dreaming as well as the incorporation of external stimuli into the dream narrative. O pensamento filosófico de Ho Chi Minh sobre a diplomacia entre o Vietnã e outros países constitui o fio condutor que guia as atividades de relações exteriores do Partido Comunista do Vietnã e do Estado do Vietnã na sua política interna de renovação. Pode se constatar, como resultado, que o Vietnã tem alcançado um significativo nível de desenvolvimento socioeconômico. Durante o período de renovação, o Pensamento de Ho Chi Minh serviu de inspiração profunda ao Partido Comunista; é de se notar (...) que o Vietnã expandiu suas relações exteriores, ao mesmo tempo em que mantém sua independência, sua soberania e a integridade territorial, associados a um acelerado processo de desenvolvimento. Este artigo aborda alguns dos princípios do pensamento de Ho Chi Minh sobre diplomacia e avalia seu papel essencial na causa revolucionária e no sucesso do Vietnã em nível internacional. Nesse mesmo tom, o artigo analisa o modo como essas ideias continuam exercer influência no contexto da diplomacia atual do Vietnã, e maneira como contribui para a construção de um ambiente internacional de paz, justiça e desenvolvimento sustentável. Basic research on the philosophy of communism in Vietnam.

Authentic assessment has been proposed as having potential to enhance student learning for a changing world. Conventionally, assessment is seen to be authentic when the tasks are real-to-life or have real-life value. Drawing on Martin Heidegger’s work, we challenge this conceptualisation as narrow and limited. We argue that authenticity need not be an attribute of tasks but, rather, is a quality of educational processes that engage students in becoming more fully human. Adopting the mode of authenticity involves calling things into (...) question, challenging public assumptions and striving to take a stand in the situations encountered. In addition to assessing student achievement, then, authentic assessment can enhance integration of what students know and how they act with who they are becoming. (shrink)

Public good contributions have been an interest for many experimental economists, since evidence has shown that people do not always behave rationally and inefficient equilibria are not always realized. This research compares a public good game run in both China and Germany with three treatments in which the social distance factor varies. The outcome shows that under a condition of high social distance, Chinese and German behavior differs with German subjects contributing more to the public good. As social distance decreases, (...) both samples converge to insignificantly different averages of contribution. It is also found that people’s contribution is positively correlated with their guess and level of anonymity: the more their identity is exposed, the more they give and the more they believe the other is giving.
